The Planning & Zoning Commission is in charge of enforcing zoning and subdivision regulations. Subdivision regulations clearly state that Open Space dedicated from an application is not to be used for stockpiling of materials, etc. The Conservation Commission is becoming quite concerned by lack of, or spotty enforcement of such regulations.
Here is a photo of an area dedicated as "open space" from Toll Brother's subdivision of Joe Wabuda's farm in White Hills off East Village Road know as "Vista of White Hills".
Apparrently, as this example shows - the Planning & Zoning Department is allowing topsoil to be scrapped off the open space dedication area, an access road to be created by depositing gravel in the former meadow/field, construction trailers and storage containers to be set in place, fuel tanks without proper safety provisions creating potential of spillage, stockpiling of trees which have been cut down, materials such as vinyl siding to be strewn about, and no trespassing signs to be put in place.
It is a shocking disregard for what should be common practices regarding open space dedications. This and other examples to be cited at this website are the reasons why the Conservation Commission is going to be more demanding in the future regarding details of approvals in regard to Open Space and Conservation Easements.
